Important/Introduction

These Terms of Use are a legally binding contract between you and Zonder Studios, Inc. We’ll refer to this entity as “Zonder.”

These Terms of Use cover your use of the Zonder consumer services, which we’ll refer to as the “Services”. These Services consist of:

  • The websites Zonderapp.com, and any other consumer websites offered by Zonder (collectively, the “Sites”);
  • The mobile app Zonder, and any other consumer mobile apps offered by Zonder (collectively, the “Apps”);
  • All services, features, content and widgets offered by Zonder in connection with the above.

These Terms of Use do not cover our enterprise (business) websites or services.

Acceptance of Terms

By registering for and/or using these Services in any manner - including but not limited to visiting or browsing the Site(s), you agree to all of the terms and conditions contained herein (“Terms of Use”), which also incorporate Zonder’s Privacy Policy, and all other operating rules, policies, and procedures that may be published from time to time on the site(s) by Zonder. Your use of these services is subject to those additional terms and conditions.

Registration & Eligibility

You may need to register for an account or use your credentials (i.e. email, first name, last name, username, or password) from a third-party social media platform (e.g. Facebook and Gmail) to access some or all of our Services. By registering for an account with Zonder, you shall provide accurate and complete registration information. Failure to keep your registration information accurate and up-to-date constitutes a breach of these Terms of Use.

You agree that you will not:

  1. Create an account for anyone other than yourself without such person's permission;
  2. Create a username that is the name of another person with the intent to impersonate that person;
  3. Create a username that is otherwise offensive, vulgar, or unlawful.

Zonder reserves the right to refuse registration of, or cancel a username, in its sole discretion. You are entirely responsible and liable for any activity that occurs on your account. You must maintain the confidentiality of your account password.

You are required to be at least 13 years of age to access or use Zonder. Zonder may refuse to offer the Services to any person or entity and change its eligibility criteria at any time.

Privacy

By using the Services, you consent to Zonder’s collection, use, and disclosure of information about you and your device as outlined in our Privacy Policy.

Your Content

All content becomes the sole responsibility of the individual who originated the content. Zonder cannot guarantee the authenticity of any content provided by users. By using Zonder, you acknowledge that all content accessed via the Service is at your own risk, and you will be solely responsible for any damage or loss resulting from its use.

Zonder Content

The Services contain content specifically provided by Zonder or its partners and licensors, and such Content is protected by various laws. Zonder grants you a personal, worldwide, royalty-free, non-exclusive, non-sublicensable, non-transferable and revocable license to access, and use the Content solely for non-commercial use.

Feedback Submission Policy

We may use your User Submissions in connection with our Sites, Services, and Zonder’s business. You grant Zonder a perpetual, irrevocable license to use, host, store, copy, modify, reproduce, distribute, prepare derivative works of, and publicly display your User Submissions.

Rules & Conduct

You must not take actions that impose an unreasonable load on our infrastructure, interfere with the proper working of the Service, run spam on the Service, or otherwise violate our guidelines.

Third Party Sites & Services

The Service may allow you to link to other websites. When accessing third-party websites, you do so at your own risk. Zonder is not responsible for the content or actions of such websites.

Termination

Zonder may terminate your access to all or part of the Service at any time without notice, which may result in the destruction of all information associated with the Services.

Warranty Disclaimer

Zonder makes no representations about the content or availability of the Services, and your use of the Services is at your own risk.

Indemnification

You shall defend, indemnify, and hold harmless Zonder from any claims related to your use of our Sites or violation of these Terms of Use.

Limitation of Liability

Zonder is not liable for any indirect or consequential damages arising from your use of our Sites or Services.

Governing Law

These Terms of Use shall be governed by the laws of the State of Michigan.

Modification of Terms of Use

Zonder reserves the right to modify or replace any of these Terms of Use at any time. Your continued use of the Services constitutes acceptance of those changes.

Cancellation of these Terms of Use

Users located in the EEA may have a right to cancel these Terms of Use within 7 days of accepting them, subject to conditions.

Miscellaneous

These Terms of Use are the entire agreement between you and Zonder and are not assignable by you without consent.

Language

Any translation provided is for convenience only, and the English version of these Terms will govern your relationship with Zonder.
